By accessing or using imaguineapig.com ("GuineaPig," "the Site," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

Age Verification

The Site is intended for users who are 18 years of age or older. By using the Site, you represent and warrant that you are at least 18 years old. If you are under 18, you are not permitted to use the Site. We do not knowingly collect information from or direct our services to anyone under the age of 18.

Service Description

GuineaPig is a search tool only. We aggregate publicly available clinical trial data from ClinicalTrials.gov, operated by the National Library of Medicine (NLM) at the National Institutes of Health (NIH), and present it with additional features such as compensation estimates, category filters, and basic eligibility indicators. We do not recruit, screen, enroll, or pay clinical trial participants.

No Medical Advice

Nothing on GuineaPig constitutes medical advice, diagnosis, or treatment. The eligibility indicators shown on the Site are based on limited criteria only (such as age and sex) and do not account for your full medical history, current medications, or overall health status. They do not constitute a medical determination of your eligibility for any study. Always consult with a qualified healthcare professional before making decisions about participating in a clinical trial.

Compensation Estimates Are Not Guarantees

The pay ranges and compensation estimates displayed on GuineaPig are algorithmic approximations generated by our proprietary estimation system. These estimates are calculated based on publicly available data including study phase, anticipated duration, visit frequency, procedure types, and typical industry compensation rates. These estimates are generated entirely by our algorithm and have not been reviewed, confirmed, or endorsed by any study sponsor, research institution, or clinical trial site.

Actual compensation for any clinical trial may be significantly higher or lower than our estimates, or may not exist at all. Some studies do not offer any monetary compensation. You must contact the study team directly to confirm:

• Whether compensation is offered and the actual amount
• Payment schedule and method
• Any conditions or requirements for receiving compensation
• Tax implications of any payments received

Do not rely on our compensation estimates when making decisions about clinical trial participation. Our estimates are provided for informational purposes only and should be used solely as a starting point for your own research.

Trial Data Accuracy

All trial data on GuineaPig originates from ClinicalTrials.gov. While we make reasonable efforts to keep information current, study details can change at any time. Studies may close enrollment, modify eligibility criteria, change locations, or be withdrawn without notice on our Site. We do not guarantee the accuracy, completeness, or timeliness of any information displayed. Always verify study details directly with the research team using the contact information provided in each listing.

Your Responsibility

You are solely responsible for evaluating the suitability of any clinical trial and for any decisions you make based on information found on GuineaPig. Before participating in any study, you should:

• Contact the study team directly to confirm eligibility, compensation, schedule, and risks.
• Discuss participation with your personal healthcare provider.
• Read and understand the study's informed consent document before enrolling.
• Verify that the study site and investigators are legitimate.

User Conduct

By using the Site, you agree that you will not:

• Automated scraping or data harvesting: Use any automated system, including but not limited to robots, spiders, scrapers, or other automated means to access the Site or collect data from the Site for any purpose without our express written permission.
• Commercial use: Use any data or content from the Site for commercial purposes, including but not limited to selling, licensing, or distributing trial information to third parties, or creating competing products or services.
• Misrepresentation: Misrepresent your eligibility, identity, health status, or any other information to study teams, research sites, or other parties in connection with clinical trial participation.
• Protocol violations: Attempt to participate in overlapping studies in violation of study protocols, or conceal your participation in other trials when disclosure is required.
• Interference: Interfere with or disrupt the Site, servers, or networks connected to the Site, or violate any requirements, procedures, policies, or regulations of networks connected to the Site.
• Circumvention: Attempt to bypass any security measures or access restrictions implemented on the Site.

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Disclaimer of Warranties

The Site and all content, features, and functionality are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Site will be uninterrupted, secure, or error-free, or that any information is accurate or complete.

Limitation of Liability

To the fullest extent permitted by law, GuineaPig and its operators, officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or opportunities, arising out of or in connection with your use of (or inability to use) the Site. This includes, without limitation, any decisions you make based on compensation estimates, eligibility indicators, or trial information displayed on the Site.

In no event shall our total liability to you for all claims arising from or relating to these Terms or your use of the Site exceed one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify, defend, and hold harmless GuineaPig and its operators, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Site or any information obtained from the Site;
• Your reliance on compensation estimates, eligibility indicators, or any other data provided through the Site;
• Your participation in any clinical trial, including but not limited to any adverse events, injuries, or side effects;
• Your violation of these Terms of Service;
• Your violation of any applicable law or regulation;
• Your violation of any rights of a third party; or
• Any content or information you submit, post, or transmit through the Site.

Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution

Before initiating any arbitration or court proceeding, you agree to first contact us at hello@imaguineapig.com and attempt to resolve any dispute informally. If we are unable to resolve the dispute within thirty (30) days after receiving your written notice, either party may proceed as set forth below.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect, except as modified by this section. The arbitration shall be conducted by a single arbitrator.

The arbitration shall take place in Wilmington, Delaware, unless you and we agree otherwise or the arbitrator determines that such venue is unduly burdensome, in which case the arbitrator may conduct the arbitration by telephone, video conference, or written submissions.

The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Class Action Waiver

YOU AND GUINEAPIG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. Unless both you and GuineaPig agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative, class, or collective proceeding.

Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction.

Opt-Out

You may opt out of this arbitration provision by sending written notice to hello@imaguineapig.com within thirty (30) days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration.

Governing Law and Jurisdiction

These Terms of Service and any dispute arising out of or relating to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware. You waive any objection to venue in such courts and agree not to assert that such courts are an inconvenient forum.

Intellectual Property

The GuineaPig name, logo, and original site content are the property of imaguineapig.com. Clinical trial data displayed on the Site is sourced from ClinicalTrials.gov and is in the public domain. You may not scrape, reproduce, or redistribute our original content without permission.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GuineaPig regarding your use of the Site and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.

Changes to These Terms

We may update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised terms. We encourage you to review these Terms periodically.
